Terms of service

1. Definitions

"Options" means Options Executive Search Pvt. Ltd., the company that owns and runs AskMenon.com. "AskMenon.com" means the website that provides the services stipulated therein and excludes all other services provided by Options.

2.  Scope

The services provided by AskMenon.com is in the nature of career guidance, transition advice and coaching, and does not guarantee employment.The services merely assists positioning of the User to take advantage of the prevailing opportunities in the job market in India and does not amount to a promise of employment. Any User availing the services provided by AskMenon.com herein agrees to and is bound by the terms and conditions stipulated herein.

3. Changes to terms

Options reserves its right to change /alter/modify and add such terms and conditions it deems fit and proper without assigning any reasons. And such modified/altered/new terms and conditions shall form part and parcel of this agreement.

4.  Price and Payment

The user agrees to pay the fee stipulated in the site Askmenon.com along with such statutory levies that may be required to be paid by the law from time to time. Options is entitled revise or modify the fee without any notice. The fee paid by the User to Options for the services of Askmenon.com are not refundable under any circumstances whatsoever.

5. Legal Action

Options may initiate such legal action as it may deem necessary or is advised or shall co-operate with any authority and provide all information, material and or such other material and information as it may have access to, to protect its rights as also of its clients, customers, users, and others who may either directly or indirectly be effected in any way.

6.  Information received from User

AskMenon.com will, for security reasons, keep a record of all the information received in writing and during the course of the interaction with the User. Options reserve their right to disclose any such information obtained from the User as may be required by Law and to protect the rights of Options and/or to comply with any judicial proceedings, court order or legal process. Subject to what is stated above Options follows the accepted industry standards to protect personal information received by them, both during transmission and once received. However no method of information over the internet or electronic storage is 100% secure. Therefore, Options while striving to use commercially acceptable means to protect the user’s personal information, cannot guarantee absolute security. Options will however make every effort to ensure that the information received from the user is maintained in a secure environment.

7.  Intellectual Property Rights
  • The Service is protected by Indian intellectual property laws and treaties. All title and copyrights the Web Site are owned by Options.
  • The User will not copy, modify, publish, transmit, transfer or sell, reproduce, create derivative works from, distribute, perform, display, or in any way exploit any of the Content,or information shared by Options with the User, in whole or in part, except as is expressly permitted in this Agreement
8. Confidentiality

The information that is provided by Options to the User is the exclusive property of Options and shall not be divulged or disclosed by the User to any person or institution. Subject to the terms and conditions herein specified, Options shall also ensure confidentiality of the personal information pertaining to the User.

9.   Indemnity

The User agrees to indemnify Options against any claim or demand, including reasonable lawyers’ fees, made by any third party due to or arising out of the Users use of the Services, the breach or violation of this Agreement by the User, or the infringement by the User, or by any other user of the Services using the User’s computer or his credentials, of any intellectual property or other right of any person or entity, or as a result of any threatening, libelous, obscene, harassing or offensive material contained in any of the User’s communications.

10.   Interruption to the Service
  • If it is necessary for Options to interrupt the Services then they may do so without telling the User first.
  • The User acknowledges that the Services may also be interrupted for reasons beyond the control of Options.
  • The User agrees that Options is not liable to the User for any loss whether foreseeable or not, arising as a result of interruption to the Services
11.   Liability of Options
  • The use of the Services and the Web Site is without any warranty or guarantee.
  • Options or their Content suppliers may make improvements or changes to the Web Site, the content, or to any of the products and services described on the Web Site, at any time and without notice to the User.
  • The User is are advised that content may include technical inaccuracies or typographical errors.
  • Options gives no warranty and nor makes any representation, either express or implied, as to:
    • the truth of any information given on the Web Site
    • compliance with any law;
    • Non-infringement of any right
  • The Web Site contains links to other Internet web sites. Options have neither power nor control over any such web site. The User acknowledges and agrees that presence of such link or other means of accessing such third party web site does not constitute endorsement, recommendation, or acceptance of any responsibility for the content of that linked web site or the operators of that linked web site and that Options shall not be liable in any way for the content of any such linked web site, nor for any loss or damage arising from User’s use of any such web site.
  • In no event shall Options be liable for any special, indirect or consequential damages or any damages whatsoever resulting from loss of use, loss of data or loss of revenues or profits, whether in an action of contract, negligence or otherwise, arising out of or in connection with the use of the Web Site or the content available from this Web Site.
  • These disclaimers form an essential part of this Agreement. Each sub paragraph in this Agreement is independent and severable from each other paragraph and enforceable accordingly. If any restriction is unenforceable for any reason but would be enforceable if part of the wording were deleted, it will apply with such minimal deletions as may be necessary to make it valid and enforceable.
12.  Nature of Service

The information that is provided by Options to the User is the exclusive property of Options and shall not be divulged or disclosed by the User to any person or institution.

13.  Modification

Options reserve their right to modify the Services and to change the terms and conditions of this agreement at any time, without notice. The continued use of the Services after such modifications shall be deemed an acceptance by the User to be bound by the terms of the modified agreement.

14.  Termination

Options reserves its right to terminate this agreement at any time, without assigning any reasons and shall issue notice of such termination through email or post to the User. Such termination shall release Options from rendering any further services assured in the website AskMenon.com. The User shall similarly be at liberty to terminate the agreement by notice in writing. Such termination shall become effective only on the User paying for the services of AskMenon.com that has been utilized by the User till such time. The User shall not be entitled for any refund whatsoever, including the unutilized portion of the services.

15.  Severability

If any of these terms is at any time held by any jurisdiction to be void, invalid or unenforceable, then it shall be treated as changed or reduced, only to the extent minimally necessary to bring it within the laws of that jurisdiction and to prevent it from being void and it shall be binding in that changed or reduced form. Subject to that, each provision shall be interpreted as severable and shall not in any way affect any other of these terms

16.  Force majeure

Neither party shall be liable for any breach of its obligations resulting from causes beyond its reasonable control including acts of God, fire, natural disaster, war or military hostilities and strikes of its own employees.

17.  No Waiver

No waiver by Options, in exercising any right shall operate as a waiver of any other right or of that same right at a future time; nor shall any delay in exercise of any power or right be interpreted as a waiver.

18.   Jurisdiction

Any dispute, differences whatsoever arising out of or in connection with this agreement or in respect of the services offered and availed from AskMenon.com shall be resolved by arbitration and shall be governed by the Laws applicable in the Republic of India. Options will appoint the Sole Arbitrator who shall hold his hearings at Hyderabad. The Courts of Competent Jurisdiction at Hyderabad alone shall have exclusive jurisdiction to deal with all disputes and differences arising from and out of the agreement and the services offered by Askmenon.com and availed by the User.
